The decision by Judge Lee Rosenthal of the U.S. District Court in Houston removed a key legal maneuver Jones used to maintain control of the platform. The ruling brings Infowars one step closer to a court-ordered sale intended to help satisfy roughly $1.4 billion in defamation judgments tied to Jones’s false claims that the Sandy Hook Elementary School shooting was a government hoax.

Jones’s counsel argued that the Infowars assets were effectively transferred into his personal bankruptcy estate in 2024, granting them protections and shielding them from liquidation.
Judge Rosenthal rejected that argument, saying neither Jones nor Free Speech Systems had the legal right to challenge the earlier bankruptcy order, leaving the court without authority to hear the case.

Ben Broocks, a lawyer representing Jones and Free Speech Systems, contended recently that keeping the assets in bankruptcy is essential to ensure a fair and competitive auction.
Kyle Kimpler, a lawyer representing the Connecticut families, countered that the court never had the jurisdiction to sell the Infowars assets. Kimpler said while Free Speech Systems’ equity interest belongs to Jones’s bankruptcy estate, the assets don’t.
